Welcome to Phidev! These Terms and Conditions (“Terms”) govern your use of our websites (phidev.com and crm.phidevinc.com), our CRM platform, and any related services provided by Phidev Incorporated, registered in Texas, USA (“Phidev,” “we,” “our,” or “us”).

By accessing or using our websites or services, you agree to these Terms. If you do not agree, please do not use our sites or services.

1. What We Do

Phidev provides digital marketing, automation, and software solutions for businesses. We also offer access to a Customer Relationship Management (CRM) platform, which we provide through a licensed, white-label version of GoHighLevel.

Our CRM helps users manage contacts, send marketing campaigns (email, SMS, etc.), and automate communication workflows.

2. Your Account

When you sign up for our CRM or other services, you are responsible for:

  • Providing accurate and current account information;
  • Keeping your login credentials secure; and
  • Using your account in compliance with all applicable laws (including marketing and data privacy laws).

If we suspect unauthorized use or misuse, we may suspend or terminate your account.

3. Use of Platform

Our CRM platform is powered by GoHighLevel, a third-party software provider. By using our CRM, you acknowledge and agree that:

  • Your data may be processed and stored on GoHighLevel’s servers, located in the United States;
  • You may receive communications (emails, SMS, calls) through GoHighLevel’s systems;
  • GoHighLevel’s own terms of service and privacy policy apply to the operation of that platform.

Phidev is not responsible for downtime, service interruptions, or data loss caused by GoHighLevel or its vendors.

4. Communications and Marketing Consent

By creating an account, submitting a form, or otherwise providing your contact information, you consent to receive communications from us — including marketing messages via email, SMS, or phone — using automated tools powered by our CRM.

You can opt out at any time by clicking “unsubscribe” in an email or replying “STOP” to an SMS.

5. Payments and Subscriptions

If you purchase a CRM subscription or other services from us:

  • Fees are due in advance based on your selected plan;
  • Subscriptions may automatically renew unless canceled before the renewal date;
  • We may change pricing with reasonable notice.

Failure to pay may result in suspension or termination of access.

6. Intellectual Property

All materials on our websites — including text, graphics, logos, and software — are owned or licensed by Phidev. You may not copy, distribute, or modify them without our written permission.

All third-party trademarks (including “GoHighLevel”) belong to their respective owners.

7. Acceptable Use

You agree not to use our CRM or services to:

  • Send spam, unsolicited marketing, or illegal content;
  • Collect or use data without proper consent;
  • Violate any privacy, telemarketing, or anti-spam law (such as CAN-SPAM or TCPA);
  • Interfere with or harm the operation of our platform.

We reserve the right to suspend accounts that violate these rules.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and share information.

Because our CRM runs on GoHighLevel, their privacy and data-handling policies also apply.

9. Limitation of Liability

To the fullest extent allowed by law, Phidev will not be liable for:

  • Any indirect, incidental, or consequential damages;
  • Loss of data, profits, or business opportunities; or
  • Service outages or data issues caused by GoHighLevel or other third-party integrations.

Our total liability will not exceed the amount you paid to us in the last three (3) months.

10. Termination

You may cancel your account at any time. We may also suspend or terminate access if you violate these Terms or engage in misuse.

Upon termination, your access will stop, but you remain responsible for outstanding payments.

11. Governing Law

These Terms are governed by the laws of the State of Texas, United States. Any disputes will be handled in the state or federal courts located in El Paso County, Texas.
